Abstract

Ismail al-Hasani’s article addresses the issue of Muslim minorities in countries that differ from Muslim countries in beliefs, values, customs, and cultures. He discusses how Muslim jurists have raised legal issues associated with the identities of Muslim minorities in non-Muslim countries. The article discusses: land division from a fiqh perspective; the social standard of land division in Islam; a critical view of land division in Islam; the difficult challenges and harms that Muslim minorities encounter in non-Muslim lands such that it requires an adaptative and positive interaction with its non-Muslim population; and the harms that result from a negative interaction with the non-Muslim population.
