تطور التنظير المقاصدي في العصر الحديث

الملخص

اعتنى هذا البحث بتقويم التنظير المقاصدي المعاصر، بدءاً بالإمام الطاهر بن عاشور، من منظور ما عدّه الباحث أبرز مقتضيات النهوض بعلم أصول الفقه الموروث لمواجهة التحديات المعاصرة، مُتجاوِزاً النظر الشكلي والتجزيئي في التعامل مع نصوص الوحي والواقع والسياق، ومُحاوِلاً تتـبُّع أهم إنجازات المعاصرين في التنظير المقاصدي من هذا المنظور، وتقويم أهم جوانب النقص التي لم يصل الإصلاح المعاصر بعدُ إلى تسديدها. وقد توصَّل البحث إلى أنَّ الخطاب المقاصدي المعاصر - بالرغم من كثرة ما أُلِّف فيه- لم يتمكَّن من الدفع بعلم مقاصد الشريعة من مرحلة التنظير والتأصيل للآليات والقواعد المنهجية إلى مرحلة جديدة ضرورية، هي مرحلة التنظير المقاصدي الـمُطبَّق في مجالات النشاط البشري المختلفة.

This article is a critical assessment of the historical backdrop to contemporary theorizations of the objectives of Sharia (Maqasid), starting from Imam Taher Ben Achour. The criterion of this assessment is what the article accepts as essential for the science of the Principles of Fiqh (Usul al Fiqh) in order to apply to contemporary challenges, i.e. the ability to go beyond the formal and fragmented approaches in dealing with the sacred texts and the context. The paper focuses upon the most important achievements in contemporary theorizing of Maqasid from this perspective, while also identifying the most important deficiencies for contemporary reform. The main finding of the research is that contemporary Maqasid-related discourse, despite the abundant literature, has not been able to shift the discipline of Maqasid from theorization of the mechanisms and methodological underpinnings to a necessary new stage – namely, the application of Maqasid theory in various fields of human activity.
